Nearville Privacy Policy

Nearville (“Nearville,” “we,” “us” or “our”) believes that maintaining the privacy and confidentiality of an individual’s personal information is important. We provide the following privacy policy (the “Privacy Policy”) to demonstrate our firm commitment to privacy. 

This Privacy Policy describes how we collect, use, retain, and disclose personal information that we collect your Personal Information on Nearville’s mobile application (“App”) and website (“Site”) (collectively our “Services”). It also explains your privacy rights with respect to your personal information. As used herein, “Personal Information,” is any information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer, device, or household. 

1. Categories and Sources of Personal Information 

Directly From You

Nearville collects Personal Information directly from you when you use our Services. The list below describes the Personal Information we have collected about you in the last 12 months.

• Identifiers: name, email address, date of birth, profile picture, address, last four digits of your social security numbers;

• Commercial information: including records of products or services loaned, rented, or purchased, bank account and credit card information;

• Geolocation data such as the physical location of the electronic device used when using our Services; and

• Any other Personal Information you choose to provide in user reviews or through the use of the AI Agent on our Site.

  
  

Through the Online Tracking Technologies 

Nearville and our third–party partners and service providers (such as advertising networks, analytics providers and social media platforms and networks) use pixels, web beacons, software developer kits, third–party libraries, cookies, and other similar online tracking technologies (collectively, “online tracking technologies”) to collect Personal Information when you interact with our Services. Such Personal Information may include how you interact with our Services, data about your device or browser, and with your consent, your precise geolocation data. Some online tracking technologies help us maintain the security of our Site and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear on our Sites, on other websites, or in our email communications

The use of such online tracking technologies may be a sale or share under applicable US state privacy laws. You can opt-out of such sales or share as described below in the section titled “Your Privacy Choices.”

2. How We Use Your Personal Information

Nearville uses Personal Information for the following business or commercial purposes:

• To operate and make available the Services including allowing users to connect with each other for the purpose of engaging in a transaction, processing payments, providing customer service, maintaining accounts; 

• To conduct internal research and analytics to improve our Services and product offerings

• To communicate with you including to respond to your questions or requests, addressing complaints and resolving disputes between users.

• To detect, investigate, prevent, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions; attempts to manipulate or violate our policies, procedures, and terms and conditions; security incidents; and harm to the rights, property, or safety of Nearville and our users, customers, employees, or others;

• To conduct marketing and send promotional communications

• Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;

• To comply with our legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim

3. How We Disclose Your Personal Information

We share Personal Information with:

• Other users of our Services – When you use our App to list an item for rent, we disclose to other users of our app the information that is included in your items listing including your first name, profile information that you choose to make public, profile picture, city, state. 

• Stripe, a vendor who provides financial transactions fulfillment – As explained in our Terms of Service, we engage Stripe for transaction fulfillment purposes. We disclose to Stripe transaction data and payment method data. 

• Vendors who support us in our business functions and operations including: sending emails, analyzing user data, providing marketing assistance, investigating fraud, and providing customer service. 

  
  

4. Sell, Share, and Targeted Advertising

We do not “sell” or “share” your Personal Information for monetary consideration, but we use your Personal Information for targeted advertising, which may constitute a “sale”, “share” or “targeted advertising”. Please refer to the Your Privacy Rights section of this Privacy Policy to learn about your right to opt-out of sale, share and targeted advertising and how you can exercise this right. Nearville does not have actual knowledge that it sells or shares Personal Information of consumers under 16 years of age.

5. Retaining Your Personal Information

Except as otherwise permitted by applicable law or regulation, to satisfy any legal or regulatory obligations, or to resolve disputes, we will retain your personal information for as long as necessary to fulfil the purposes for which we collected it. In determining what constitutes an appropriate retention period for personal information, we consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information, and whether those purposes can be achieved through other means.

6. Your Privacy Rights

Depending on your state of residence, you may the following rights and choices regarding our processing of your Personal Information

• To know the categories and/or specific pieces of Personal Information collected about you, including the source of your Personal Information, whether it is sold or disclosed and the purpose, and with whom your Personal Information was disclosed;

• To request deletion of Personal Information, if permissible by law;

• To correct inaccurate Personal Information we retain about you;

• To opt-out of “sale” and/or “share” of your Personal Information, targeted advertising, and profiling  

• To limit the use of your sensitive Personal Information; 

• To nondiscrimination based on the exercise of a consumer’s privacy rights; and

8. Do Not Track Signals 

We do not currently respond to web browser “do not track” signals. Visit the following website, www.allaboutdnt.org, for more information.

9. California’s “Shine the Light” Law

Under California’s Shine the Light law, California residents are entitled to opt-out of the disclosure of their personal information to third parties for their direct marketing purposes. Because Nearville does not share Personal Information to third parties for their direct marketing purposes, it does not offer this opt-out right. 

10. Amendments to this Privacy Policy

Nearville may revise this Privacy Policy periodically and will post the date it was last updated at the top of this Privacy Policy.
